LEGAL SERVICES

Agreements / Contracts

Contract Law is the body of law that governs agreements between parties. A contract can be either verbal or written. However, a written contract is certainly far easier to prove in court if necessary. Contract Law encompasses not only the writing of contracts, but also their interpretation and, in the event of a dispute between the parties about anything contained in the contract, the resolution of such a dispute.

Notarial Work

In order to practice as a notary in South Africa, an attorney must pass an additional test and be admitted by the High Court as a notary. As a result, they are qualified to practice in legal matters that other attorneys without the necessary credentials cannot.
In the areas of conveyancing, marriage, immigration, and document authentication, a notary’s services are frequently needed.

These are the notarial services that we provide:

  • Antenuptial contracts
  • Servitudes

Conveyancing

Conveyancing or property transfers refers to the process by which the lawful ownership of an immovable property is obtained. Ownership is only obtained upon registration of the property, in the buyer’s name, in the Deeds Registry Office.

Each time a property is sold, a new deed of transfer must be drawn up and registered. This is to ensure the security and certainty of an owner’s title to his property. This security document, or deed of transfer, is drafted by a specialized attorney known as a “conveyancer”.
